What is a whistleblower system?
A whistleblower system enables employees and external persons to anonymously and securely report violations of laws or internal rules, such as fraud, corruption or data protection offences. It protects whistleblowers from reprisals and fulfils legal requirements.
Who is obliged to set up a whistleblower system?
Companies with more than 50 employees, as well as certain professional groups (e.g. lawyers, tax consultants), are legally obliged to provide a whistleblower system, at the latest since the Whistleblower Protection Act came into force.
What does the Whistleblower Protection Act (HinSchG) regulate?
The law protects whistleblowers who report violations from dismissal, harassment or discrimination. It stipulates how reporting centres must be set up, operated and documented in a confidential, GDPR-compliant and secure manner.

What requirements does the HinSchG place on a whistleblower system?
The system must be secure, confidential, GDPR-compliant and independent. It must adhere to deadlines (e.g. confirmation of receipt within 7 days, feedback within 3 months) and offer the option of submitting reports in writing or verbally.
What can be reported via the whistleblower system?
